Terms of Service

Effective 7 October 2026

These terms are an agreement between Angelo Falcone (trading as FalconVox), ABN 57 175 606 083 ("FalconVox", "we") and the business that creates a FalconVox account ("you"). By creating an account you accept them on behalf of that business. FalconVox is a service for businesses, not for consumers.

1. The service

FalconVox provides an AI voice receptionist that answers your calls, a booking calendar, a customer list, call logs and related emails (together, the "service"). What the assistant tells callers comes from the information you enter in your dashboard.

2. Your account

  • Give accurate information and keep it up to date — especially your opening hours, services and prices.
  • Keep your password secret. You are responsible for what happens under your account.
  • The person who signs up must be authorised to bind the business.

3. Fees and payment

  • The service costs a one-off setup fee plus a monthly plan, at the prices shown on our website and at checkout. Each plan includes a number of call minutes per billing month (each call rounded up to the next minute; unused minutes don't carry over). Minutes beyond that are charged at your plan's per-minute rate: as soon as they add up to A$50 within a billing month, and otherwise on the next invoice (or when your plan ends). The monthly fee is charged in advance through Stripe; prices are in Australian dollars and, if we become registered for GST, include it.
  • If a payment fails we will retry it and your AI receptionist keeps answering for 3 days. If it still hasn't been paid by then, the receptionist is suspended until it is, and switches back on automatically once the payment goes through.
  • We will give at least 30 days' notice by email before changing the price of your subscription.
  • You can cancel at any time from Settings → Subscription. Cancellation takes effect at the end of the period already paid for. The setup fee and part-periods are not refundable, except where the law requires otherwise.

4. Your responsibilities

  • Use the service lawfully, and only for calls and bookings of your own business.
  • The assistant tells every caller that it is a virtual assistant and that the call may be recorded. You remain responsible for complying with the call-recording, privacy and consumer laws that apply to your business, including having your own privacy notice for your customers.
  • The service is not an emergency service and must not be relied on for urgent, medical, clinical or safety decisions. Health businesses must not use the assistant for triage.
  • Check bookings in your dashboard: the assistant can mishear or misunderstand callers.
  • Call-forwarding charges from your phone provider are yours.

5. Acceptable use

You must not use the service to make unsolicited or automated marketing calls, to deceive callers, to process information you have no right to, or to break the law; and you must not try to copy, reverse-engineer, overload or get around the security of the service.

6. Data protection

For information about your callers and customers you are the controller and we are your processor. We will:

  • process it only to provide the service and on your documented instructions (these terms and your dashboard settings);
  • make sure our staff and contractors are bound by confidentiality;
  • keep it secure with appropriate technical and organisational measures;
  • use only the sub-processors listed in our Privacy Policy and tell you before adding or replacing one, so you can object;
  • help you answer requests from people exercising their privacy rights, and with any security or impact assessments you must carry out;
  • tell you without undue delay after becoming aware of a personal data breach affecting your data;
  • let you export your data at any time and delete it when your account closes, as described in the Privacy Policy;
  • give you the information needed to show we meet these obligations.

Transfers outside Australia or the EEA are covered by the safeguards described in the Privacy Policy.

7. Ownership

Your data stays yours; you give us permission to use it only to provide the service. We own the FalconVox software, voice agent design and everything else we provide.

8. Availability and changes

We work to keep the service running around the clock but do not guarantee it will be uninterrupted or error-free; it depends on telephone networks and providers we don't control. We may improve or change features, and will tell you in advance about changes that reduce what you pay for.

9. Suspension and termination

You can close your account at any time (Settings → Your data). We may suspend or close an account that breaks these terms or isn't paid, with notice where reasonable. After closure your data is deleted as described in the Privacy Policy, so export it first if you need it.

10. Liability

To the extent the law allows, the service is provided "as is"; we are not liable for indirect or consequential loss, including lost bookings, revenue or profit; and our total liability under these terms is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes rights that cannot be excluded by law, including guarantees under the Australian Consumer Law; where we are allowed to limit our liability for breach of those guarantees, it is limited to supplying the service again or paying for it to be supplied again.

You are responsible for, and will cover us against, claims arising from your unlawful use of the service or from information you had no right to give us.

11. General

We may update these terms; we will email you at least 30 days before a material change applies, and continuing to use the service after that means you accept it. These terms are governed by the law of South Australia, Australia, and its courts have jurisdiction. Questions: falconvox.info@gmail.com, South Australia 5008, Australia.
